It has been a busy month for federal developments concerning per- and polyfluoroalkyl substances (“PFAS”). On April 19, the U.S. Environmental Protection Agency made headlines again, announcing the prepublication version of its final rule designating two PFAS compounds—perfluorooctanoic acid and perfluorooctanesulfonic acid, including their salts and structural isomers—as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act.

On April 23, the U.S. Department of Labor published the “Retirement Security Rule: Definition of an Investment Advice Fiduciary,” which makes changes to the definition of “ fiduciary” for purposes of the Employee Retirement Income Security Act of 1974, as amended. This is DOL’s fourth attempt in recent years, after much political volleying, to expand fiduciary duties to nearly all transactions involving retirement investments.

The Federal Trade Commission adopted a controversial rule for noncompete provisions yesterday. As expected, the final regulation, which was first proposed in January 2023, will prohibit virtually all noncompete restrictions, which the FTC claims will lead to increased wages and innovation and improve the American economy.

The U.S. Department of Labor just announced significant revisions to the Fair Labor Standards Act regulations, increasing exempt employee salary thresholds, resulting in an estimated 4 million additional employees becoming eligible to receive overtime. The DOL emphasized that the new thresholds provide clear and predictable guidance for employers and are intended to “ensur[e] that lower-paid salaried workers receive their hard-earned pay or get much-deserved time back with their families.” The changes under the rule will begin to take effect July 1, 2024.
